1. Acceptance of these terms
These Terms of Use ("Terms") are a binding agreement between you and Wise Guy Team LLC, P.O. Box 26406, Scottsdale, AZ 85255 ("WGT," "we," "us") governing your use of wiseguyteam.com, our member dashboard and tools, our emails, text messages, push notifications, Telegram and Discord channels, and all content and services we provide (together, the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy, Disclaimer, and Responsible Gambling policy, which are part of these Terms. If you do not agree, do not use the Service.
2. What we are, and are not
WGT is a sports handicapping information, analytics, and education service. We publish opinions, analysis, statistics, tools, and educational content. We are not a sportsbook or gambling operator. We do not accept, place, or broker wagers, and nothing on the Service is an offer to bet. We are not financial, investment, legal, or tax advisors, and nothing on the Service is financial, investment, or professional gambling advice.
3. Eligibility and age
You must be at least 18 years old to use the Service. If you choose to place wagers with any third party, you must be of legal wagering age in your jurisdiction (21+ in most U.S. states) and located where such wagering is lawful. You are solely responsible for knowing and complying with the laws that apply to you. The Service is marketed to United States residents.
4. Your account
Keep your login credentials (including magic-login links sent to your email) confidential. You are responsible for activity under your account. One account per person; memberships are personal and may not be shared, resold, or redistributed. We may suspend or terminate accounts that violate these Terms.
5. Memberships, trials, and billing
We offer free and paid memberships, including: promotional trials (for example, $1 for the first 7 days) that convert to an auto-renewing weekly subscription at the price stated on the checkout page unless cancelled before the renewal date; auto-renewing weekly or monthly subscriptions; one-time prepaid passes (for example, day, weekend, and "rest of year" passes), which do not auto-renew; and pay-per-result offers where a charge applies only under the conditions stated in that offer. The price, billing frequency, renewal terms, and any trial terms for each product are stated on its checkout page at the time of purchase; that checkout-page disclosure controls. Payments are processed by Stripe or our other payment processors; we do not store your full card number. Promotional pricing (including coupon codes) applies only as described at checkout. One promotional trial per customer, household, and payment method unless we say otherwise.
6. Cancelling
You can cancel any auto-renewing subscription at any time, effective at the end of the current billing period, directly from your account settings online. Cancellation is available by the same means you signed up and takes effect without needing to call, email, or give advance notice. You may also cancel by emailing memberservice@wiseguyteam.com or texting (702) 209-0098. After cancellation you keep access through the end of the period you already paid for; prepaid passes simply expire on their stated end date.
7. Refunds
Because our products deliver their value immediately upon release of picks and access to tools, purchases are generally non-refundable. We may, at our sole discretion, issue a refund, credit, or other accommodation in individual cases (for example, billing errors, duplicate charges, or access problems). Contact memberservice@wiseguyteam.com and we will review your situation. A discretionary refund in one case does not entitle anyone to a refund in another. Nothing in this section limits rights you may have under applicable law.
8. Communications and how to stop them
(a) Email. By providing your email you consent to receive service and account emails and, unless you opt out, marketing emails which may arrive daily during sports seasons. Every marketing email includes an unsubscribe link, and supported inboxes may also use one-click unsubscribe; opting out of marketing does not stop transactional messages you have paid for (your picks, receipts, account notices). (b) Text messages. If you opt in to text alerts, you agree to receive recurring automated texts from WGT at the number you provide (see our SMS Terms). Consent to texts is not a condition of purchase. Message frequency varies; message and data rates may apply; reply STOP to cancel, HELP for help. (c) Push, Telegram, and Discord. Notifications you enable can be disabled at any time in your browser or device or by leaving the channel. (d) Contact preferences never affect your membership access.
9. Membership channels
Paid memberships may include access to member-only Telegram or Discord channels. Those platforms have their own terms. Channel access is part of your membership: it begins when your membership begins and is removed when your membership ends, and we may remove any user from a channel for abuse, harassment, or sharing member content outside the channel.
10. Tools, odds, and data
The Service includes betting tools and data feeds (odds boards, line shopping, betting splits, expected-value and arbitrage calculators, player props, bet tracking, alerts, and similar features). You agree and understand that: (a) all tool output is informational and educational only; (b) odds, lines, availability, and promotions change constantly and are sourced from third parties. Data may be delayed, incomplete, or wrong, and a price shown on the Service may no longer exist at any sportsbook; (c) you must independently verify any line, price, or offer directly with the sportsbook before placing any wager; (d) calculators and edge or arbitrage figures are mathematical estimates based on the data at hand, not promises of profit. An "arbitrage" or "+EV" label describes the inputs, not a guaranteed outcome; and (e) we may add, change, or remove tools at any time.
11. AI-generated and automated content
Portions of the Service are generated or assisted by artificial intelligence and automated systems, including game previews and articles, the AI betting coach chat, certain emails and alerts, and "Digital Ross" videos (an AI-generated likeness used with Ross Thornton's authorization and labeled as AI). AI and automated content can be wrong, incomplete, or out of date, and can misstate odds, injuries, schedules, statistics, or other facts. AI output, including every response from the AI coach, is entertainment and educational information only, is not advice of any kind, is not a prediction guarantee, and must not be your basis for wagering without independent verification. We review and correct AI content through automated and human checks, but we do not warrant any particular piece of content is accurate.
12. Your content (bet tracker, chat, testimonials)
You keep ownership of content you submit (for example, bets you log in the tracker or messages you send). You grant us a non-exclusive, royalty-free license to host and process your content to operate the Service, and, only where you give us permission or post publicly, to display it (for example, testimonials). Do not submit content that is unlawful or that you lack rights to. We may remove user content at our discretion.
13. Records, results, and testimonials
We publish our documented picks record and grade results against official box scores; our methodology is described on the how-we-grade page. Past performance does not guarantee future results. Individual results vary. Most recipients of any pick do not bet identical amounts at identical prices, and many people who bet on sports lose money. Testimonials reflect individual experiences and are not typical-result claims.
14. Errors and corrections
Despite our checks, the Service may contain errors: wrong odds, stale injury news, misgraded results, mispriced offers, or misfired alerts. We correct errors when we find them and appreciate reports to memberservice@wiseguyteam.com, but we are not liable for your reliance on erroneous content, and an erroneous price or offer on our site creates no entitlement against us or any sportsbook.
15. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INTERRUPTION. We do not warrant that any pick will win, that any tool output is correct, that the Service will be uninterrupted, timely, or error-free, or that picks or alerts will be delivered to your inbox or device.
16. Assumption of risk
Sports wagering involves substantial risk of loss. Every wagering decision you make is yours alone, made at your own risk, with money you alone control. You may lose some or all of what you wager regardless of anything published on the Service.
17. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WGT AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR WAGERING LOSSES OF ANY KIND, ARISING FROM THE SERVICE, INCLUDING RELIANCE ON ANY PICK, TOOL, AI OUTPUT, ALERT, OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations; where prohibited, these limits apply to the fullest extent permitted.
18. Indemnification
You will indemnify and hold WGT and its owners, members, officers, employees, and agents harmless from claims arising out of your misuse of the Service, your violation of these Terms, or your violation of law (including wagering where you may not lawfully wager).
19. Intellectual property
The Service's content, tools, design, and branding are owned by WGT or its licensors and protected by copyright and trademark law. You may not copy, scrape, redistribute, resell, or frame our content or picks without written permission. To report content you believe infringes your copyright, contact us at memberservice@wiseguyteam.com.
20. Prohibited conduct
No unlawful use; no sharing or reselling picks or member content; no scraping, hacking, reverse engineering, or interfering with the Service; no harassment of our team or other members; no fraudulent payments. Initiating a chargeback for charges you authorized, instead of contacting us first, may result in termination of access; we respond to payment disputes with our records of your signup, usage, and communications.
21. Termination
You may stop using the Service at any time (see the Cancelling section for paid plans). We may suspend or terminate access for violation of these Terms; if we terminate without cause, we will refund the prorated unused portion of any prepaid period. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) survive.
22. Changes to these Terms
We may update these Terms; the "Last updated" date will change and material changes will be notified by email or on-site notice. Continued use after changes take effect is acceptance.
23. Governing law, arbitration, and class-action waiver
These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Nevada (or conducted remotely), rather than in court, except that either party may bring an individual claim in small-claims court. You and Wise Guy Team LLC each waive any right to a jury trial and to participate in a class, collective, or representative action; disputes will be arbitrated only on an individual basis. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms.
