1. Acceptance of these terms
These Terms of Use ("Terms") are a binding agreement between you and Wise Guy Team LLC, a Nevada limited liability company ("Wise Guy Team," "WGT," "we," "us," or "our"). By accessing or using wiseguyteam.com, our content, picks, tools, communications, or any paid or free membership (together, the "Service"), you agree to these Terms, our Privacy Policy, our Disclaimer, and our Responsible Gambling policy. If you do not agree, do not use the Service.
2. What the Wise Guy Team is (and is not)
The Service is a sports handicapping information, education, and analytics service. We publish documented betting selections ("plays" or "picks"), historical results, and research and analytics tools including betting splits, live odds comparison, line shopping, player-prop tools, a +EV board, a parlay builder, calculators, and an AI assistant.
We are not a sportsbook, casino, bookmaker, or gambling operator. We do not accept, place, broker, or settle wagers, do not handle or hold any betting funds, and do not pay out winnings. Any bet you place is between you and a licensed third-party sportsbook, made solely at your own discretion and risk. We are not a financial advisor, investment advisor, or broker, and nothing on the Service is financial or investment advice.
3. Eligibility and age requirements
You must be at least 18 years old to use the Service. Sports wagering is restricted by age and location; you must be of legal gambling age in your jurisdiction (21+ in most U.S. states) and physically located where such wagering is legal before placing any bet. You are solely responsible for knowing and complying with the laws that apply to you. The Service is intended for users in jurisdictions where access is lawful; it is your responsibility to ensure your use is permitted where you are.
4. Accounts and registration
Some features require an account. You agree to provide accurate information, keep your credentials confidential, and accept responsibility for activity under your account. Accounts are personal to you. You may not share, sell, transfer, or provide access to your account or to the picks, and you may not redistribute, resell, or republish any pick, data, or content from the Service. We may suspend or terminate accounts that violate these Terms.
5. Memberships, billing, trials, and renewals
We offer free and paid memberships. Paid memberships are billed through our payment processor, Stripe; we do not store your full card details. By starting a paid plan you authorize us and Stripe to charge your payment method for the plan you select, including any applicable taxes.
- Recurring plans (e.g., weekly or yearly) automatically renew at the then-current price until you cancel. Introductory or trial pricing (for example, a $1 first week) applies once per customer and converts to the standard recurring price at the end of the introductory period unless you cancel before it renews. If you have used an introductory offer before, you may be charged the standard price immediately.
- One-time purchases (such as a season-long Owner Selections package or a voluntary tip) do not auto-renew.
- We may change prices or plan features prospectively; we will provide notice as required by law, and changes take effect on your next billing cycle.
6. Cancellation
You can cancel anytime from your account settings or the Stripe customer portal. Cancellation stops future renewals; your access continues through the end of the period you have already paid for. We may present a retention or alternative offer at cancellation, but accepting one is always optional and you can complete your cancellation without it.
7. Refunds
Except where required by applicable law, all sales are final and payments are non-refundable, including one-time purchases and voluntary tips. Because memberships can be cancelled at any time to prevent future charges, we do not provide partial or prorated refunds for unused time. If you believe you were charged in error, contact us at memberservice@wiseguyteam.com and we will review it in good faith.
8. Picks, tools, and AI - no guarantee of results
All picks, selections, betting splits, odds, line-shopping data, player-prop tools, +EV ratings, parlay suggestions, calculators, and AI assistant outputs are provided for informational and entertainment purposes only. They are opinions and analysis, not a prediction or guarantee of any outcome.
We do not guarantee any winnings, profit, or results. Sports betting involves substantial risk of loss, and you can lose some or all of the money you wager. Our published historical record reflects past results only and past performance does not indicate or guarantee future results. You are solely responsible for every wager you choose to place, including stake size. The AI assistant generates automated responses that may be inaccurate or incomplete and must not be relied on as advice.
9. Third-party odds, data, and sportsbook links
Odds, lines, betting percentages, scores, and related data are obtained from third-party providers and the sportsbooks themselves. This data may be delayed, incomplete, or inaccurate, and can change at any time. Always confirm the current line and terms at the sportsbook before betting. Links to sportsbooks and other third parties are provided for convenience; those sites are operated by independent companies under their own terms, and we are not responsible for them. We may earn a commission from some of these links - see our Affiliate Disclosure.
10. Acceptable use
You agree not to: (a) copy, scrape, mirror, resell, or redistribute any picks, data, or content; (b) share or resell account access; (c) use bots, scrapers, or automated means to access the Service; (d) reverse engineer or interfere with the Service or its security; (e) use the Service for any unlawful purpose or in any jurisdiction where it is prohibited; or (f) infringe our or others' rights. We may suspend or terminate access for any violation.
11. Intellectual property
The Service and all content, branding, software, and design are owned by Wise Guy Team LLC or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to access the Service for your own personal, non-commercial use. All other rights are reserved.
12. Communications consent (email and SMS)
By creating an account or providing your contact information, you consent to receive Service-related and marketing emails. If you provide a mobile number and opt in, you consent to receive recurring text messages (which may be sent via an automated system); message and data rates may apply, consent is not a condition of purchase, and you can opt out at any time by replying STOP or contacting us. 13. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. We do not warrant that any pick, data point, tool output, or AI response is accurate, complete, current, or will result in any particular outcome.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WISE GUY TEAM LLC AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY GAMBLING OR BETTING LOSSES, LOST PROFITS, OR LOST DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Wise Guy Team LLC and its owners, members, officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your wagers, or your breach of these Terms or of any law.
16. Governing law, arbitration, and class-action waiver
These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Nevada (or conducted remotely), rather than in court, except that either party may bring an individual claim in small-claims court. You and Wise Guy Team LLC each waive any right to a jury trial and to participate in a class, collective, or representative action; disputes will be arbitrated only on an individual basis. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms.
17. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new "Last updated" date, and material changes take effect when posted (or as otherwise required by law). Your continued use of the Service after changes means you accept them.
18. Termination
We may suspend or terminate your access to the Service at any time for any violation of these Terms or for any lawful reason. You may stop using the Service and cancel your membership at any time. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
